These terms govern your use of jabiitech.com and the services provided by JABIITECH LLC, a North Carolina limited liability company. By using our website or services, you agree to these terms.
Our services
JABIITECH provides AI-powered communication services to businesses, including automated phone answering, appointment scheduling, text message follow-up, and related automation. The specific services provided to a client are set out in the agreement between JABIITECH and that client.
SMS Terms and Conditions
This section applies to anyone who receives text messages from JABIITECH LLC.
Program description. JABIITECH LLC sends text messages to individuals who have provided their mobile number and agreed to receive them. Messages include appointment confirmations, appointment reminders, service updates, and replies to inquiries you have submitted to us.
How to opt in. You may opt in by checking the consent box on a form at jabiitech.com, or by giving verbal consent during a phone call with us or with a business using our services. Consent is never assumed and is never required as a condition of purchase.
Message frequency. Message frequency varies depending on your interaction with us. You will typically receive messages only in connection with an appointment or an inquiry you initiated.
Cost. Message and data rates may apply. These charges come from your mobile carrier, not from JABIITECH. Check your plan for details.
How to opt out. Reply STOP to any message from us. You will receive one message confirming that you have been unsubscribed, and we will send no further messages unless you opt in again.
How to get help. Reply HELP to any message, or contact us using the details at the bottom of this page.
Carriers. Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Virgin Mobile, Cricket, and others. Carriers are not liable for delayed or undelivered messages.
Delivery. We cannot guarantee that every message will be delivered. Delivery depends on your carrier, your device, and network conditions outside our control.
Privacy. Your mobile number and consent data are handled as described in our Privacy Policy. We do not share mobile information with third parties or affiliates for marketing or promotional purposes.
Acceptable use
You agree not to use our website or services to:
- break any law or regulation
- send unsolicited, harassing, deceptive, or fraudulent messages
- impersonate another person or business
- interfere with, probe, or attempt to gain unauthorized access to our systems
- copy, scrape, or resell any part of our services without written permission
Client obligations
If you are a business using JABIITECH services, you are responsible for:
- obtaining valid consent from every individual you message through our platform
- the accuracy and legality of the content you send
- complying with the Telephone Consumer Protection Act, CAN-SPAM, CTIA guidelines, and all applicable communication laws
- honoring opt-out requests promptly
- maintaining your own privacy policy and terms where required for message program registration
JABIITECH may suspend service immediately if we have reason to believe messages are being sent without valid consent.
Fees and payment
Service fees are set out in your service agreement. Fees are billed monthly in advance and are non-refundable except where required by law. We may change our prices with 30 days' notice. Telephony and messaging usage charged by third-party carriers is passed through at cost unless your agreement states otherwise.
Cancellation
Either party may cancel with 30 days' written notice. On cancellation, we will provide a reasonable export of your contact data. We may suspend or terminate service immediately for non-payment or for breach of these terms.
AI-generated communication
Our services use artificial intelligence to generate responses in phone calls and text messages. AI systems can produce errors, including incorrect appointment details or inaccurate information. Clients are responsible for reviewing and supervising the output of their configured systems. JABIITECH is not liable for losses arising from AI-generated content, and clients should not use our services for communications where an error would cause serious harm.
Disclaimers
Our services are provided "as is" and "as available." We do not warrant that they will be uninterrupted, error-free, or that they will produce any particular business result. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, JABIITECH LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim.
Indemnification
You agree to indemnify and hold harmless JABIITECH LLC and its members and employees from any claim, loss, or expense, including reasonable attorneys' fees, arising from your use of our services, your content, or your breach of these terms — including any claim that messages were sent through our platform without valid consent.
Governing law
These terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Mecklenburg County, North Carolina, and both parties consent to that jurisdiction.
Changes
We may update these terms. When we do, we will change the "Last updated" date. If the changes are significant, we will notify clients by email. Continued use after changes take effect means you accept the updated terms.
